While our general stance at the site is that too many people are being incarcerated for crimes that should not require time behind bars, throwing a baby out of a second story window wouldn’t fit into that category. And unfortunately, that is exactly what a 16 year old girl from Nebraska did.

According to the Omaha World-Herald, the 16 year old threw her newborn baby out of a second story window, which tragically ended the baby’s short life.  The shock and disgust of the situation does not end there however, the Juvenile Court Judge ordered the teen to probation, to reside in a group home, participate in therapy, delete her precious Facebook, and complete 50 measly hours of community service.

Initially, the 16 year old was charged as an adult for one count of felony child abuse resulting in death; the punishment for which was 20 years to potentially life in prison. However, the case was transferred to a juvenile court due to a “lack of criminal record,” which was an interesting decision given that the teen’s defense attorney stated she “only had a theft on her record.”   I don’t know about the average 16 year old, but a theft conviction and potential felony child abuse charge seems like a lot for someone still two years away from legal adulthood.    In her defense, her attorney claimed that the teen thought the baby was stillborn, but I’m not sure that makes the situation any better.

Overall, the sentencing appears to be a little light given the gravity of the circumstances. Though it was from a different state, a 17 year old boy from New York was sentenced to 3 to 9 years in prison for shaking his baby to death, which seems more appropriate for the outcome of the crime.
